Tax Commissioner: Appealing Tax Assessment

Law allows taxpayers to appeal assessments The Peach County Board of Tax Assessors is required by Georgia Law to send out an assessment notice informing taxpayers of valuation changes. Upon receiving the notice, a taxpayer has 45 days from the date on the notice to file a written appeal. Time is crucial ... late appeals are invalid.

An appeal must be filed with the Peach County Board of Tax Assessors within the time provided. The Board of Tax Assessors will review the valuation, taxability or uniformity issues in question. The value may be changed, or the appeal will be certified to the Board of Equalization.

The address to submit appeals:
Board of Tax Assessors
205 W. Church Street, Suite 221
Fort Valley, Ga. 31030

Upon receipt of the appeal, the Board of Equalization will set a date and notify the appellant, at least 20 days in advance of the time and place for the hearing. The taxpayer, or his duly authorized representative, and the Board of Tax Assessors, or their duly authorized representative, shall both be present at the hearing before the Board of Equalization. Each party will be given an opportunity to present his side of the issue.

The Board of Equalization shall decide each question presented by the appeal. Notice of the decision shall be given to each party. The appellant’s notice shall be sent by certified mail.

Taxpayers may choose not to have their appeal heard by the county board of equalization and have the option of appealing the county board of tax assessors’ assessment to an arbitrator or arbitrators.

The taxpayer or the Board of Tax Assessors may appeal the decision of the Board of Equalization to the Superior Court of Peach County. The appeal by either party must be filed within 30 days from the date the decision of the Board of Equalization is mailed.
